OSCE/ODIHR Opinion on Draft Amendments to the Moldovan Criminal and Contravention Codes relating to Bias-motivated Offences
This Opinion was prepared in response to a request of the Deputy Minister of Justice of Moldova received by ODIHR in December 2015. It reviews the revised Draft Amendments communicated to ODIHR in February 2016.
The OSCE/ODIHR commends Moldova for the initiative to strengthen the legal framework to fight against bias-motivated offences and notes that the chosen legislative approach largely corresponds to good practice in this field at the international level. Nevertheless, the Opinion also advises to clarify the wording of certain provisions to ensure that they meet the requirements of legal certainty, foreseeability and specificity for criminal law, in particular given that some of them have the potential to unduly restrict freedom of expression.
